GENERAL CONTRACT CONDITIONS
Information prior to the contractual process
For the purposes of the provisions of Art. 10.1 of Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce, it is stated that the service provider is SORAYA HERNÁNDEZ BLASCO (hereinafter, The Palmera) with registered office at C/ Aguada, 24, 04149 Aguamarga (Almería) and NIF. 34856278P.
Each time a reservation is made through this Website, a sales contract will be established between you as a user and La Palmera; Said contract will be governed by these Terms and Conditions, as well as, specifically, by the General Conditions of Contract that are detailed below.
La Palmera reserves the right to make any changes it deems appropriate, without prior notice, to the General Conditions. Said modifications may be made, through its Websites, by any legally admissible form and will be mandatory during the time they are published on the web and until they are validly modified by subsequent ones. However, La Palmera reserves the right to apply, in certain cases, Particular Conditions of Contract in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.
The purpose of the website is the exploitation of hospitality services in hotels.
The use of these services will imply the full and unreserved acceptance, and the validity, of each and every one of the General Terms and/or Conditions that will be considered automatically incorporated in the contract signed with La Palmera, without their being necessary. written transcript in the same contained in the latest updated version of these General Terms and/or Conditions.
For the purposes of the provisions of Art. 27.a) of the LSSI-CE, contracting through www.hostalrestaurantelapalmera.net will be carried out through the following steps:
– Selection of dates of stay.
– Choice of the type of room, number of them, and number of people.
– Selection of accessories and additional services with a sample of the final price. Insertion of both personal data related to the reservation, as well as the bank card used as a guarantee of the reservation, and acceptance of the general conditions of the reservation.
– Verification of the reservation data.
– Formalization of the reservation, confirmation page sample.
– Sending confirmation email of the reservation with its data.
La Palmera will generate a comprehensive electronic document of the formalization of the reservation for its file, giving access and full knowledge of it to the client by sending an email with its content at the end of the reservation process.
After the formalization of the reservation, the client is requested to review its content in order to identify possible material errors in the introduction of data, to process its correction, call the corresponding telephone number of our reservation center or send your comments to: www.hostalrestaurantelapalmera.net providing the identification data of the reservation.
The reservation is confirmed and guaranteed with the payment by accepted credit card or BIZUM of the amount of half the stay. This amount will not be refunded in case of cancellation. In case of no-show at the hotel without prior notice on the day of arrival, the total amount of the reservation will be charged to the card that you have provided us (VAT and fees included).
Termination of the contract or cancellation of the reservation
The credit card is a means of guarantee. The cancellation of reservations by the user will cause early cancellation costs, hostalrestaurantelapalmera.net will charge the cancellation costs as compensation, which will amount to the amount of half of the stay charged as a guarantee. If the stay is for one day, the total amount of the reserved stay will be charged.
Our contracting procedure is offered in the following languages: Spanish, English. To be able to change the language, access the language drop-down menu at the top right of any La Palmera page.
According to the specific conditions of the specific rates applied to the reservation, the payment of the same may be made (i) in advance, totally or partially, at the time the reservation is formalized, it is necessary to pay the amount of half of the stay as a guarantee and deposit by credit card accepted or BIZUM to the telephone number 676 726 819. In case the stay is one day, the total amount of the stay will be charged.(ii ) at the time the client registers at the hotel, the rest of the amount of the stay will be charged to the same card or BIZUM at the telephone number 676726819 (check-in) Payments can be made by credit card accepted at the establishment, and/or by payment by BIZUM to the telephone number 676726819, and/or in cash through legal tender in the country of the hotel.
Modification or cancellation policy
In the event that on the day of arrival the client does not show up, nor has he called by phone to cancel the reservation, we will charge the amount of the rest of the stay on the card that he provided us.
These clauses are not valid for reservations made with special rates. In this case, the respective established conditions will apply.
During the booking process you will be informed of the cancellation conditions.
Right of withdrawal
The legal clause regarding the right of withdrawal will not apply to reservations made through www.hostalrestaurantelapalmera.net or the telephone reservation service, in any case the particular conditions of the offer regarding cancellation will apply. To make it effective, you must contact the hotel directly at the telephone number, postal address or email address consigned in the reservation confirmation message, providing the identification data of the reservation.
Those under 18 years of age must stay at the Hotel accompanied by their parents, guardians or adults duly authorized by them. Hotel staff may require the relevant documentation that identifies adults as their parents/guardians or authorized persons.
Likewise, La Palmera reserves the right to present civil or criminal actions that it deems appropriate for the improper use of its website and content or for the breach of these conditions.
The relationship between the user and the provider will be governed by the regulations in force and applicable in Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. La Palmera is domiciled in Almeria, Spain.
